According to court documents, the incident stems from an alleged altercation that took place on April 23. The alleged victim told authorities that he entered an elevator and was followed by an unidentified male and female.
The victim stated that the pair began acting in what he described as an “uncontrollably intimate” manner, including aggressive kissing, as the elevator ascended. Upon exiting on the 12th floor, the victim reportedly told the couple to “please have some manners.”
According to the report, the situation escalated immediately after the comment. The victim alleges that the unidentified male began attacking him, punching him multiple times and pushing him to the ground. The report also states that threats of further violence were made.
A motion was filed Thursday morning requesting permission for Barthel to travel. The filing cited travel as a requirement of his profession.
Barthel learned of the warrant while in Mexico and voluntarily returned to Florida to turn himself in. His attorney, Thomas D. Sommerville, entered a not guilty plea on his behalf and requested a trial.
Court filings also note that Barthel has no prior criminal history and intends to comply with all court appearances. As part of his release conditions, he is prohibited from contacting the alleged victim.
WWE has not released an official statement regarding the situation.
